These Terms & Conditions (“Terms”) govern your access to and use of the website, products, services, quotations, and transactions of Creatik Innovative Solutions Pvt. Ltd. (“Creatik”, “Company”, “we”, “us”, or “our”).
By accessing this website, submitting an enquiry, requesting a quotation, placing an order, or purchasing any product or service from Creatik, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the website or our services.
1. Products & Services
Creatik provides corporate gifting products and related services, including customised merchandise, branded gifts, gift hampers, promotional products, packaging, branding, sourcing, and fulfilment.
Product images, colours, specifications, dimensions, and appearances displayed on the website are for general representation and may vary slightly from the final product due to manufacturing processes, screen settings, materials, lighting, or supplier variations.
Creatik reserves the right to modify product specifications or availability without prior notice, subject to confirmed orders.
2. Quotations & Orders
All quotations are subject to product availability, applicable taxes, customisation requirements, quantities, delivery location, and the validity period specified in the quotation.
A quotation shall not constitute a binding obligation until the order is formally confirmed by Creatik.
Orders may require a purchase order, advance payment, written confirmation, or other documentation as specified by the Company. Creatik reserves the right to reject or cancel an order where products are unavailable, information is incomplete, payment is not received, or fulfilment is otherwise commercially or operationally impractical.
3. Customisation & Artwork
For customised or branded products, the Customer shall provide accurate logos, artwork, names, text, specifications, and other required information.
The Customer represents that it has all necessary rights, licences, and permissions to use such materials and authorises Creatik to use them solely for fulfilling the order.
Where artwork, samples, mock-ups, or proofs are provided for approval, the Customer shall verify all details before providing final approval. Creatik shall not ordinarily be responsible for errors contained in Customer-approved artwork or specifications.
Minor variations in colour, alignment, placement, finish, or printing may occur as part of the manufacturing process.
4. Pricing & Payment
Prices shall be as stated in the applicable quotation or order confirmation. Unless expressly stated otherwise, applicable GST, taxes, freight, delivery, customisation, and other statutory or additional charges shall be payable by the Customer.
Creatik may require full or partial advance payment depending upon the nature of the order.
Where credit terms have been approved in writing, payments shall be made within the agreed credit period. The Company reserves the right to suspend production, dispatch, or services for overdue payments.
5. Delivery
Delivery timelines provided by Creatik are estimates unless expressly agreed otherwise in writing.
Timelines may be affected by product availability, artwork approval, production, supplier schedules, transportation, weather, government restrictions, or other circumstances beyond the Company’s reasonable control.
The Customer is responsible for providing accurate delivery details and ensuring that an authorised person is available to receive the shipment. Additional costs resulting from incorrect addresses, failed deliveries, re-routing, or storage may be charged to the Customer.
6. Cancellation, Return & Replacement
Customised, branded, personalised, printed, engraved, embroidered, or specially procured products generally cannot be cancelled or returned once production or procurement has commenced.
Cancellation requests must be submitted in writing and are subject to acceptance by Creatik. Where cancellation is accepted after work has commenced, the Customer may be liable for costs already incurred, including procurement, production, branding, packaging, freight, and related expenses.
Any manufacturing defect or material discrepancy should be reported promptly after delivery, together with reasonable supporting evidence. Where a defect is established and attributable to Creatik, the Company may, at its discretion and subject to applicable law, repair, replace, or otherwise resolve the affected product.
7. Intellectual Property
All trademarks, logos, photographs, graphics, text, designs, website content, and other intellectual property belonging to Creatik or its licensors remain their respective property.
Customers retain ownership of their own logos, trademarks, artwork, and brand materials but grant Creatik a limited right to use such materials solely for fulfilling the relevant order.
No intellectual property rights are transferred to the Customer through use of the website or purchase of products.
8. Customer Responsibility
The Customer is responsible for ensuring that information, artwork, branding, recipient details, and other materials supplied to Creatik are accurate and lawful.
The Customer shall indemnify and hold Creatik harmless against claims, losses, damages, liabilities, or expenses arising from infringement of third-party intellectual property rights, unlawful Customer Materials, inaccurate information, misuse of products, or breach of these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Creatik shall not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of its website, products, or services.
Subject to applicable law, the Company’s total liability relating to a specific order shall not exceed the amount actually paid by the Customer for the affected products or services.
Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.
10. Force Majeure
Creatik shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, fire, flood, war, civil unrest, strikes, epidemics, government restrictions, supply-chain disruptions, transportation failures, material shortages, power failures, or similar events.
11. Privacy & Communications
Creatik may collect and process Customer information for enquiries, quotations, order processing, invoicing, delivery, customer support, and other legitimate business purposes.
By submitting an enquiry or placing an order, the Customer agrees to receive necessary transactional and service-related communications from Creatik. Personal information shall be handled in accordance with applicable law and the Company’s Privacy Policy.
12. Website Use
The website may not be used for unlawful, fraudulent, unauthorised, or malicious purposes. Unauthorised copying, scraping, distribution, modification, or commercial exploitation of website content is prohibited.
Creatik reserves the right to suspend or restrict access where misuse or violation of these Terms is reasonably suspected.
13. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any dispute arising from these Terms, products, services, or transactions with Creatik shall first be attempted to be resolved amicably. Subject to applicable law, unresolved disputes shall be subject to the jurisdiction of the competent courts at [Mumbai, Maharashtra, India].
